Please read the following Terms and Conditions carefully before making a reservation. By booking your stay, you acknowledge and agree to these Terms and Conditions in their entirety.
We understand that unexpected circumstances may arise that require you to cancel your reservation. However, as a small business, we rely on reservations to support our operations. Therefore, we have implemented the following non-refundable cancellation policy for cancellations made within 7 days of the scheduled check-in time of 4 PM:
Cancellation within 7 Days:
1.1. If you cancel your reservation within 7 days of the scheduled check-in time of 4 PM, the reservation is considered non-refundable.
1.2. No refund or credit will be provided for any portion of the reservation amount paid, regardless of the reason for cancellation.
2.1. In the event of unforeseen and extenuating circumstances, such as a documented medical emergency, natural disaster, or government-imposed travel restrictions, we may consider refunding or rescheduling your reservation on a case-by-case basis. Supporting documentation may be required.
2.2. Any exception to the non-refundable policy will be at our sole discretion.
No Shows and Early Departures:
3.1. In the event of a no-show or early departure, the reservation is considered non-refundable. No refund or credit will be provided for any unused nights or services.
Change of Reservation Dates:
4.1. If you need to change your reservation dates, we will make every effort to accommodate your request, subject to availability.
4.2. Any changes to the reservation dates within 7 days of the scheduled check-in time of 4 PM may be subject to additional fees or charges.
5.1. We strongly recommend purchasing travel insurance to protect yourself against unforeseen events or circumstances that may cause you to cancel or modify your reservation.
By making a reservation with us, you acknowledge and agree to the terms of this non-refundable cancellation policy. Please ensure that you carefully consider your travel plans and any potential risks before confirming your reservation.
1.1. The rental agreement is formed between the guest(s) and the property owner/manager. The terms of this agreement are legally binding upon acceptance of the reservation.
Reservation and Payment:
2.1. To secure a reservation, a non-refundable deposit or full payment may be required at the time of booking, as determined by the property owner/manager.
2.2. The guest shall make full payment of the rental fee and any applicable security deposit 8 days before the check-in date, unless otherwise agreed upon in writing.
2.3. Payments can be made by a valid credit card or any other method approved by the property owner/manager.
Occupancy and Guest Responsibility:
3.1. The maximum number of guests allowed is as specified in the reservation details, unless otherwise agreed upon in writing.
3.2. The guest is responsible for providing the accurate number of guests and ensuring that all occupants comply with the property rules and regulations.
3.3. The guest must be at least 18 years old. The property owner/manager reserves the right to request identification proof from the guest prior to check-in.
Check-in and Check-out:
4.1. Check-in time is usually after 4 PM CT, and check-out time is before 11 AM CT, unless otherwise agreed upon in writing.
4.2. Early check-in or late check-out may be accommodated, subject to availability and additional charges.
Property Use and Conduct:
5.1. The guest agrees to use the property for lawful purposes only and in a responsible manner.
5.2. The property shall not be used for any commercial purposes, parties, events, or gatherings without the prior written consent of the property owner/manager.
5.3. The guest shall respect the quiet enjoyment of neighbors and not create excessive noise or disturbances.
5.4. Any behavior deemed to be illegal, disorderly, or in violation of local laws or regulations may result in immediate eviction without refund.
Property Care and Damages:
6.1. The guest agrees to treat the property with care and respect and to leave it in a reasonably clean condition upon departure.
6.2. The guest will be held responsible for any damages caused by themselves or their guests during their stay.
6.3. The property owner/manager reserves the right to charge the guest's credit card or withhold the security deposit to cover the cost of repairs or replacement due to damage, loss, or excessive cleaning requirements.
Liability and Insurance:
7.1. The guest agrees to release and indemnify the property owner/manager from any liability, loss, or damage arising from the guest's use of the property or any amenities provided.
7.2. It is strongly recommended that the guest obtains adequate travel and personal liability insurance to cover any unforeseen circumstances during their stay.
Cancellation and Refunds:
8.1. The cancellation policy is as specified in the reservation details, unless otherwise agreed upon in writing.
8.2. No refunds will be issued for early departures or unused nights unless otherwise agreed upon in writing.
9.1. These Terms and Conditions constitute the entire agreement between the guest and the property owner/manager, superseding any prior agreements or understandings.
9.2. Any modifications or amendments to these Terms and Conditions must be made in writing and agreed upon by both parties.
9.3. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Additional terms and conditions:
The home is 123 years old; please treat it with respect and leave it as you found it (do not move furniture or place wet or hot items on top of antique furniture, etc.).
Exterior security cameras are on site.
Hosting an unauthorized party will result in eviction and forfeiture of your deposit/funds paid.
Extra guests (or dogs) outside of what you stated in your reservation are not allowed; additional charges may be applied.
FLAME: NOT allowed inside since the home is made of old, solid wood (no smoking and/or candles including birthday candles). If a county burn ban is in place, please do not BBQ outside
TOILET: Old septic system. please only flush toilet paper. Do NOT flush wet wipes or feminine products ~ even if the package states that they are "flushable". Place all wipes and feminine products in the bathroom trash can.
DIRTY DISHES: Kindly wash your dirty dishes, pretty please.
DIRTY TOWELS: Place in hamper (don't put wet towels on antique floors).
TRASH: Leave it in trash can. Do not leave any trash or food on the porches because critters will rip it apart.
POND: It is not fenced/gated. Stay away from steep slope. Owners will not be held responsible for any injuries to humans or dogs.
TV/INTERNET: Starlink Wifi. By using our network, you agree to use it only for legal purposes and will not to use it for illegal uploading, downloading, or other illegal activities (this is verbiage that Airbnb recommends).
EMERGENCIES: Dial 911. Fire station is 1/2 mile away. Fire extinguisher is by kitchen sink. First Aid kit is in bathroom drawer. Brenham Hospital is 9.4 miles away.
MOTHER NATURE: The cottage will be cleaned and disinfected prior to your arrival. However, we cannot guarantee that you won't encounter any insects during your stay. Mother Nature may leave some surprises for you, as one can expect in the country. I am terrified of most insects so trust me when I say that we spray to keep bugs away!
DOGS: Max of 2 dogs allowed. Please respect our dog rules below. We'd hate to exclude dogs in the future due to one rude dog owner. Don't be the person who ruins it for other dog people...because KARMA :-). Dog bowls, toys, pooper scooper and a small crate is on the property for your use. Rules:
1. Dogs must be crated inside when you leave the property
2. Dogs are NOT allowed on the beds or sofas
3. Scoop dog poop prior to check out :-). Bags are on porch.
Dog fee is $100 per dog per stay. Maximum of 2 dogs allowed.
CATS: Not allowed (we love cats but sorry!)
MISC ITEMS BELOW: We shouldn't have to mention but we are mentioning just in case!
SMOKING/VAPING: Allowed OUTSIDE only. Please properly dispose of butts in the ashtrays (do not litter or throw them in the yard, creek, road).
WET ITEMS/MUDDY SHOES/DIRTY DOGS: Wet items can damage the antique wood floors. Dog wipes are located on front porch.
ROBES: Enjoy the fluff! If they disappear, you'll be charged $30 per robe.
NOISE: No loud music, fireworks, or firearms allowed. It scares the deer. Kindly respect the neighbors and noise ordinance/quiet hours.
Do not trespass on neighboring properties.
Kovacik Cottages LLC will not be responsible for any injuries that occur on the property.
LONG STAYS (more than 28 days): Guest must schedule a house cleaning with our housekeeper every 7-10 days.

3.1. We may share your personal information with third-party service providers, such as payment processors, to facilitate bookings, process payments, and provide related services.
3.2. We may disclose your personal information to comply with applicable laws, regulations, legal processes, or enforceable governmental requests.
3.3. We do not sell, rent, or trade your personal information to third parties for marketing purposes.
4.1. We employ industry-standard security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction.
4.2. Despite our best efforts, no method of transmission or storage over the internet is completely secure. Therefore, we cannot guarantee the absolute security of your personal information.
5.2. Upon request, we will delete or anonymize your personal information, unless we are legally obligated to retain it or if its retention is necessary to resolve disputes or enforce our agreements.
6.1. Our services may contain links to third-party websites or services. We are not responsible for the privacy practices or content of such third parties. We encourage you to read the privacy policies of these third parties before providing any personal information.
7.1. Our services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected personal information from a child, we will promptly delete it from our records.
